How I Can Help You

As a criminal defense lawyer, it is my goal to educate each client on the charges they face, possible penalties, and the judicial process. I work to protect my clients rights and help them make informed decisions in reaching the best possible outcome.

As a former Deputy District Attorney in Colorado, I have an insight into the inner workings of the DA’s office, as well as the entire criminal justice system. Because there are such a large caseloads in Larimer County, Weld County, and the Denver metro area, prosecutors have to analyze the cases on their docket quickly and make rushed decisions. Many Coloradoans and visitors to our state face criminal charges without the assistance of a lawyer, and feel they have no other choice than to take the deal– a decision many regret years, months or even days later.

Education
I attended Lipscomb University, a private, liberal arts university in Nashville, Tennessee, where I received my Bachelor of Arts in Political Science and German. I then moved across the country to earn my Juris Doctorate at the University of Denver, Sturm College of Law.

Experience
I left law school with the strong desire to serve the community, so I became a Deputy District Attorney. As a prosecutor, I managed hundreds of criminal cases and tried dozens of those cases before juries. Since entering private practice as a criminal defense attorney in 2013 I have consistently and effectively defendant clients charged with violent crimes, sex offenses, DUI and DWAI, domestic violence enhancers, child abuse, drug crimes and crimes against property. I invest extra time to continuing education in the areas of criminal defense, criminal procedure and evidence so as to provide a top quality legal practice year after year.

Experienced attorney Terry O'Malley discusses pretext calls in cases of Sexual Assault on a Child -- C.R.S. 18-3-405, and Sexual Assault -- C.R.S. 18-3-402. We are criminal defense attorneys in the Denver area who specialize in helping people with sex offense cases.
What is a pretext call?
A pretext call is a tactic used by police and sheriff's deputies to trick you into making statements about your guilt over the phone when you don't know that police are listening in. Imagine that a girl has made an allegation that you had inappropriate sexual contact with her. The police will invite this woman, teenager, or child to make a phone call to you from the police station. The police in Denver, Littleton and Aurora have a device that fools caller ID's. The number that appears on your phone will be the alleged victims -- but in reality, the phone call is at the police station with officers listening in. You think you're speaking with the girl when she's at home, or in a safe environment. In reality, your conversation is being recorded at the police station.
Why do the police do this?
The police utilize this tool in order to gain evidence against you in court. They will feed the girl information, and steer her questions in order to gauge your answers. They take notes and record the entire conversation. They are looking for certain components that they need in order for a conviction. Once they get you to say one thing, they'll steer the conversation another way in order fill all the elements necessary to convict you of sexual assault on a child, or sexual assault.
What should I do?
If you have any indication that a child wants to talk to you about sexual contact- that you may or may not have had -- refuse to participate over a phone call. It is a much safer option to meet that girl in a public place like a restaurant: recording devices are much less frequent (although they do exist).
My advice? Don't talk to a child, the parent of a child, or anyone at all about prior sexual contact if they contact you and ask questions like: "I want to resolve some issues," or "did this mean anything to you?" Traditionally, this is not something that a child talks about, unless they are being prompted by a police officer or sheriff's deputy on the other end of the line. Even if you don't admit guilt, they will use everything you say to convict you.
If you or a loved one has been accused of a crime in Colorado, be smart, exercise your right to remain silent, and contact a criminal lawyer at the O'Malley Law Office at 303-830-0880. Together, we can protect your future.
