I am worried that my husband will conceal assets. How can I ensure a fair settlement?

That is a very common concern and I'm so glad that this question has been asked because particularly if your husband doesn’t know that you're thinking about divorce or he hasn't sought anything out, now is the time to look for bank statements, look for records of accounts because all of your sleuthing at this point is, one, very smart and it's going to help us so much to look at the full picture.

Now, the law is there to protect you and there's what's called full disclosure so we will expect your husband to turn over all bank statements and through his work and employment we'll see accounts and we're very good at really sifting through those and determining where all of the assets are and then once we know where everything is then you can have the information you need to hopefully settle the case in a way that is favorable to you.

Do I have to have evidence that my husband is doing something wrong to get a divorce in Florida?

Florida is what we call a no fault divorce state. So, what that means is there is no proof of wrongdoing on your part for you to seek a divorce and there's also no waiting period.

In many ways, it can be a short process if the two of you agree. But the main thing that you will have to tell the court, and we will ask you about, is whether or not your marriage is irretrievably broken. That could be just because you don’t want to work at it anymore and that's all that the court is going to require.

My husband provides all of our income. How can I maintain my lifestyle after divorce?

Well, right now you're in a really scary situation. Your husband has been supporting the family financially and you may not have the background or really time, energy or capabilities to earn money on your own. So, we are going to have to look at what are your needs financially and what is your husband's ability to pay?

We know he has the ability to pay because he's been supporting the family during the entire marriage but we're going to have to really analyze what are you going to need and how much are we going to be able to get your husband to pay you on a monthly basis for support. That really all goes into the alimony evaluation.

So talk to a lawyer, do the best you can to gather bank statements, any financial information that way we can really begin to give you an idea of what your life is going to look like.
