Background: Client was stopped for allegedly turning left on a red light by two sheriff's deputies. The deputies both claimed that my client had a "strong odor" of alcoholic beverages coming from his person/vehicle and he was the sole occupant of said vehicle. At the time of the stop, my client was only in the country for about two years, and his grasp of the English language was minimal. Despite this hardship, the deputies never called in an interpreter (who was a radio call away). After my client "failed" the field sobriety tests, despite the fact that he did not understand ANY of the instructions because they were not in his native tongue, he was arrested for DUI and blew 0.153 at the police station which resulted in him being charged with an aggravated DUI (because he blew above 0.150).
A previous attorney was getting ready to plea my client guilty, but because my client was a CDL operator, he could not risk losing his license for a year. So he fired his previous dui attorney and came to me. I immediately realized the language barrier issue and filed a motion to suppress the 0.153 BAC due to his lack of understanding the implied consent that was read to him not in his native tongue. Said motion was granted and the number was suppressed.
Notwithstanding this hardship, the prosecution continued to move forward -- emphasizing the principles of "justice" and "fairness" and that my client had to "pay for what he has done." So we proceeded to trial. My client testified. The jury believed him and found him NOT GUILTY on May 10, 2018 in Jefferson County District Court Division 102 with the Honorable Jessica Moore presiding.

16-year Military Captain gets falsely accused of a DUI.
His BAC is tested by a faulty machine and registers a whopping 0.117 (almost 1.5x the legal limit).
He wanted his own blood test because, as he told me, he drank the night before (10-12 hours ago) and has not had anything since, so the number is completely inaccurate and that is why he told the breathalyzer technician that he wanted HIS OWN test done.
The officer who took him to the jail and then the hospital did not want my client to take the blood test because it would have proven his innocence.
We won, and got the DUI dismissed, by getting the officer to admit that he didn't even make an ATTEMPT (as he must accommodate a suspect in custody under Commonwealth v. Long) to get my client access to a phone arguing that "my client's wife was 45 minutes away and they didn't have time for that."
They didn't even call her to check where she was.......
Had they did, they would realize that she was 3-5 minutes driving away.
We won and got the DUI dismissed.

The facts: Military E4 Specialist on trial for DUI. Officer was a rookie, and did EVERYTHING WRONG. Not holding it against him, but he was trying to ruin my client's future (his promotion to E5 was now withheld as a result of this charge). We tried to settle the case pre-trial, but the prosecution would not have any of it.
So, we went to trial and the jury believed my client (who took the stand and testified) and his DD from earlier in the day (DD drove my client home, where he slept off the alcohol and then drove to girlfriend's house -- when he got pulled over for speeding).
Jury acquitted him of DUI, but convicted him of speeding (which ONLY incurs a $20 fine and court costs of $135.) Client paid that, gave me the biggest hug in the world, and went home happy.
The jury deliberated for JUST OVER FIVE (5) MINUTES BEFORE ACQUITTING MY CLIENT (the prosecution's closing is cut out, it took about 10-12 minutes).

How do you beat a DUI? Shortly, it is done by discrediting the evidence. Therefore, there are many ways to beat a drunk driving charge. A DUI attorney in Louisville, Kentucky knows all the details, but below is an example on how to beat a DUI.
First thing to know in beating a DUI is how a prosecution attorney will try to get a DUI conviction. There are two ways he will try to prove DUI. One way will be to attack the driver's mental and physical condition presenting evidence that shows the driver was impaired because their alcohol consumption. Another way is by concentrating on the driver's blood-alcohol content and not focusing on the driver's physical or mental condition. Or, the prosecutor could use both methods in the same case.
A DUI case will hinge on four kinds of evidence: physical appearance of a driver, driving pattern, results of a chemical test, and the results of the field sobriety test. All of them are subject to debate in a variety of ways, and this is where beating a DUI case happens. For example, start with the driving pattern. If the defendant pulled over promptly, used his turn signal, parked safely, etc., it could be well argued that the driving pattern did not indicate any impairment.
The field sobriety test is also open to debate. A defense attorney might argue that a true test allows time for students to study beforehand instead of taking it on the spot; that they get to do it in a quiet room instead of outside with distractions like traffic rushing by; and that getting 10% of the answers wrong shouldn't necessarily result in a failing grade.
Then there is the argument about mental impairment being evidence of physical impairment. Experts on both sides agree that when alcohol is consumed, mental impairment is evidenced before physical impairment becomes evident. The prosecution may prove physical impairment, but if DUI Attorney Larry Forman in Louisville, Kentucky can discredit the presence of mental impairment, he may rightfully assert that the alleged physical impairment was the result not of alcohol but of something else, like injury or fatigue.

There are a LOT of questions about whether or not this information is still accurate as of 2023.
Allow me to answer each point in turn.
Question 1 Q. Is it a crime to refuse the breath test? A. In some states, YES. NOT in Kentucky, BUT in some states it IS a crime to refuse the test, so in those states consult with local counsel, but I have HEARD (this not legal advice -- see below) that it is better to consent in those states because EVEN IF you win in those states, and there are about 16 of them, I believe, you could STILL be convicted of the CRIME of refusal. So in some states and countries, you should NOT refuse because you will be convicted of THAT crime, instead. In Kentucky, it is not a crime to refuse the breath test and that is why I advocate that you should "CHOOSE TO REFUSE (or you will lose)". In fact, for about 5 years back in the 1980's refusals were inadmissible at trial. Now they are admissible, but the state doesn't have the BEST possible evidence against you (since you refused), which is the number.
Question 2 Q. Is this information still accurate and applies in 2020? A. In some states, including Kentucky, YES. If you refuse the test (breath, blood or urine) you DEPRIVE the state of the BEST possible evidence they could ever have against you. If you submit to the tests, you are now arguing with chemical evidence requiring the testimony of an expert (possibly), which are very expensive -- by having to attack the machine or methodology used to extract and test the breath, blood or urine, etc. So, by SACRIFICING your license and LOSING your privilege to DRIVE, your attorney may now have a better shot at beating your case at trial because now it becomes a he said she said battle in open court, which is way easier to argue against than, say, a 0.092 breath or blood test result, etc.
A further point on this issue -- In Kentucky, we can get you back behind the wheel DAY ONE of your suspension (if it's an alcohol DUI) with the ignition interlock device. So you can get back on the road.
Question 3 Q. Can I still be arrested if I refuse? A. Almost 100% YES. You will be arrested with almost 100% certainty if you refuse the test by the side of the road anywhere in the world because now the officer will DEFINITELY suspect that you are under the influence and refusing the test because you are hiding something.
Question 4 Q. Is the Preliminary Breath Test (PBT) admissible? A. In nearly all states, NO. In Kentucky and most other states, the PBT is NOT admissible in court and can ONLY be used for purposes of probable cause to arrest -- not in order to convict you at trial. I do NOT believe it is a crime to refuse the PBT in any state, as far as I know (again, not legal advice).
Question 5 Q. Can I refuse to do the Field Sobriety Tests (FSTs)? A. YES. In Kentucky, and probably every other state, there is NO penalty (other than getting arrested) for refusing the FSTs. In fact, by refusing to complete the FSTs, you deprive the government of even MORE evidence to be used against you. As I describe in the video, the tests are DESIGNED to fail you. So why consent to them? I say refuse. Get arrested. And fight it in court. NOT ON THE STREET. You will always always always lose on the street.
Question 6 Q. Can they take my blood by force or with a warrant? A. In some states, YES. But not in Kentucky unless there is an accident which involves death or serious physical injury.
