Am I protected by implied warranties if the products documents included a disclaimer of all implied warranties? | English, Lucas, Priest and Owsley, LLP | Personal Injury, Nursing Home Abuse and Negligence, Pharmaceutical and Medical Product Injury and Wrongful Death attorneys | 1101 College Street, Bowling Green, Kentucky 42101 | http://injury.elpolaw.com | (270) 781-6500

It's clear under Kentucky law that implied warranties may be disclaimed or modified, however that disclaimer or modification must be clear and conspicuous. However, to the extent that you have warranty claims under Kentucky products liability law, you may be able to pursue other claims either under expressed warranties or simple negligence.

Should I accept a settlement offer in my Kentucky product liability case?
Should I accept a settlement offer in my Kentucky product liability case? | English, Lucas, Priest and Owsley, LLP | Personal Injury, Nursing Home Abuse and Negligence, Pharmaceutical and Medical Product Injury and Wrongful Death attorneys | 1101 College Street, Bowling Green, Kentucky 42101 | http://injury.elpolaw.com | (270) 781-6500

I would highly encourage you not to accept a settlement offer that has been proposed to you by a product manufacturer in Kentucky without first seeking the advice of an experienced Kentucky product liability attorney. The biggest problem that you have in accepting an offer is that they're going to ask you to sign a release which would do away with all of your claims. One of the things that we see in almost all releases is that the release has what we call indemnity language. That indemnity language would require you to reimburse your healthcare provider or your insurance provider that is has paid all of your medical bills. Sometimes the medical bills exceed the amount of your settlement, thus putting yourself in a whole.

What are the life changing effects of a brain injury?
What are the life changing effects of a brain injury? | English, Lucas, Priest and Owsley, LLP | Personal Injury, Nursing Home Abuse and Negligence, Pharmaceutical and Medical Product Injury and Wrongful Death attorneys | 1101 College Street, Bowling Green, Kentucky 42101 | http://injury.elpolaw.com | (270) 781-6500

As an attorney who has handled a lot of brain injury cases, the most difficult part of handling a brain injury case is that most of the time the injury can't be seen. Very few times does it occur where you can see some type of scar or some type of trauma to the head. Normally it is just an accident that happens and an injury that happens that you cannot see. It makes it very difficult not only for the person who has suffered the injury, but also their family who has to deal with the very significant mood swings of their family member. Lots of times we help get the necessary medical treatment for the client, and also the necessary neuropsychological testing to determine how significant the brain injury is. It not only helps the client cope, but also helps the family deal with this very significant problem.

The Kentucky wrongful death statute has specific provisions regarding recovery on behalf of a minor. The statute determines who is able to receive benefits and if the only benefits that are payable to a minor, then they are allowed by the wrongful death statute. Typically what we do in those cases is obtain court approval of the settlement which is required and normally put that money in a trust, a block account, or annuity to benefit the child once they turn eighteen years of age.

What we find the most of our medical device in pharmaceutical cases is that our clients had their medical device implanted several years ago or took the drug several years ago and they're now being faced with a recall or notice that the product was defective. One of the reasons that it's so important to get to an attorney early is that there are or could be some specific problems with statute of limitations and because of that, you need an attorney who is very experienced in the medical device in pharmaceutical cases to assist you to make sure that you can comply with the applicable statute of limitations.

The statute of limitations for a defective product in Kentucky is like other personal injury cases, it is one year from the date of the injury or from the accident. If it involves a minor, the statute of limitations does not begin to run until the minor turns 18 years of age. That one year would expire on his or her 19th birthday.

In a Kentucky defective product case, we ask for a number of damages. We are able to get the medical bills, both past and future, on behalf of our client. We also ask for the income that was lost in the past, also the income that will be lost in the future, in addition to the pain and suffering. If it involves a wrongful death claim, in addition to the damage that I just mentioned, we also are entitled to get the funeral bills and medical bills on behalf of our deceased client.

Most all the job injuries in Kentucky are covered by the Kentucky worker's compensation laws. However, it's important that you find an experienced attorney who handles worker's comp cases to determine if there is any third party liability. That is, if a third party who is not affiliated with your employer causes your injuries, you may be entitled to other damages that are not covered under the Kentucky workers comp law. This includes pain and suffering and income benefits that may otherwise not be recoverable under the Kentucky worker's comp laws.

Residential swimming pool owners can be responsible for injuries or death that occur on their property. Most of the time their liability is determined based on the status of the person who was killed or injured. That is, if a trespasser is injured or killed on the premises of the swimming pool owner, there is very limited liability in most situations. However, to the extent that the person has been invited onto the premises, then there could be significant liability associated with a person who is injured or deceased in that swimming pool.

Yes, there are different types of brain injury. Most of the time, we see the brain injury that results from an accident or some type of trauma to the head. The most recent case that we had involved a young man who fell off of a cliff in a church camp and significantly injured himself. We also see cases where there is a severe hypoxic event where there is a deprivation of oxygen to the brain that may result in significant brain damage to a minor child or an adult who may have suffered a heart attack or been without oxygen for a period of time.

There are several different statute of limitations in a Kentucky fraud and liability case. The statute of limitations on the implied warranties and express warranties may be longer than one year, however, if you've been injured as a result of a defective product, you should seek the advice of an attorney immediately who handles these types of cases, because normally the statute of limitations is one year.

Brain injury trials and proceedings are almost like any other case or proceeding. First we focus on proving the liability of the defendant. The second thing that we would focus on would be determining how the negligence of the defendant caused the brain injury. Normally, that's done through the treating doctors. It also may be done through an expert witness that we would hire to do neuro-psychological testing on our client.

Whether a product is dangerous or defective is normally proven through the use and hiring of an expert witness. One of the reasons to hire an attorney who has significant experience handling products liability cases is that attorney is going to have at his or her access, top-notch engineers and experts in the field of product liability law that can help them with that case.

Brain injury cases are very specialized and require a high level of experience from the lawyer who will be handling them. I would recommend that when you're hiring an attorney to handle a brain injury case, that you select the attorney like you would the physician. Kentucky does not recognize specific areas of expertise in the law, but it will allow you to hire an attorney that has a high level of knowledge and experience in terms of handling brain injury cases.
I would first recommend that you look at the attorney's website to determine their level of experience in handling brain injury cases. Ask specific questions from the attorney during your first meeting with them.

In Kentucky we have a very favorable rule called, "The Discovery Rule." Under Kentucky law and the Discovery Rule, the statute of limitations does not begin to run until one year from the date that you discovered that the product was defective, or that you should have discovered it. As it relates to a parents' medical bills or lost wages that they are claiming, the statute of limitations would begin to run on the date that they discovered that the product was defective.
For a minor child, that statute of limitations would not begin to run until the 18th birthday of the child. Thus, the statute of limitations would expire on the child's 19th birthday.

The statute of limitations in a brain injury case is like any other personal injury case in Kentucky. The statute of limitations begins to run one year from the date of the accident or the injury. If the accident or injury is to a minor, the statute of limitations begins to run once the minor turns eighteen years of age. Thus the one year statute of limitations would expire on the nineteenth birthday of that child.

The first thing I would recommend would be to hire an attorney who can help you get an estate set up for your loved one. It will be necessary to get the estate set up in order to have access to the medical records and other important documents related to the product. The second important thing is to make sure that you hire an attorney that has significant experience handling product liability cases. That attorney can make sure to determine whether or not the product was defective and if so, what impact it had on your close family member's death.

It's very easy to file a brain injury case in Kentucky. It's like any other lawsuit. I would suggest that you hire an attorney that has significant experience handling these types of cases.
