There isn’t much related to bankruptcy or foreclosure he has not already seen. Dave is admitted to practice in Maryland and the Federal Courts, including the U.S. Bankruptcy Court and the U.S. Supreme Court. He lives near Annapolis with his family.

How Much Debt Do You Need To File For Bankruptcy
When people come into our Waldorf or Lexington Park office for a free bankruptcy consultation, there are certain questions they will ask.  One of these is “How much debt do you need to have to file for bankruptcy?”  The truth is that there is no minimum amount of debt that you are required to have to be eligible to file. The general test to determine if you have enough debt to file for bankruptcy is that you need to show that you are insolvent. That means you can’t afford to pay your bills as they come due.  And that even if you sold your assets you couldn’t pay off your debt in full.

This sounds straight forward enough.  But it is a bit of a circular if you think about it. To file for bankruptcy you have to be insolvent.  But insolvency is just another word for bankruptcy. So to show you have enough debt to file for bankruptcy you have to show that you are bankrupt. But don’t get too worried about this word game, or the question of do you have enough debt to file for bankruptcy. One of the reasons we offer a free bankruptcy consult is that people never want to file for bankruptcy.  Because of this they hardly ever look into bankruptcy unless they have enough debt to be able to file. What To Bring To Your Bankruptcy Consult
When people call to schedule their initial consultation in our Lexington Park or Waldorf office they usually want to know what to bring. Our answer is “Just bring yourself”. For the initial consult our main goal is to get an overall picture of your financial situation. We will have plenty of time down the road to look over tax returns and pay stubs. We find that if we focus too much on these details we may miss something important. Often a person calls because of some triggering event like a lawsuit or a foreclosure notice. Bringing these notices for us to take a look at is always a good start. However, at this first meeting we want to focus on the forest, not just tree that is in front of you.

To help get the big picture we start by asking a page full of questions that helps us get an over all picture of your financial situation. It may not be the most personal way to start a meeting, but to answer any of your questions in a meaningful way we need all of this information first. By plodding through and getting this information down on paper not only will we be able to answer your questions we will probably be able to anticipate most of them. More importantly these questions help us to quickly figure out what options you have. That way we can thoroughly explain these options so you will be able to decide which one is best for you.

While explaining the process and steps associated with each of the options, we will also share which one we feel makes the most sense for you and why. The Different Types Of Bankruptcy

Other times a person just comes in to find out what options they may have. Preparing for Your Meeting of Creditors
Dave Gormley prepares Southern Maryland bankruptcy clients for their 341 Meeting of Creditors in Greenbelt Maryland. This meeting is called a “341 meeting of creditors” because it comes from section 341 of the Bankruptcy Code. That regulation requires that you attend this meeting so the bankruptcy trustee can question you about your income, expenses, debts, and property.
