Often times, when a client comes to us for their first DUI, we are able to negotiate with the State’s Attorney and obtain a probation before judgment, instead of a conviction. If you agree to plead guilty, the State makes their recommendation to the judge. However, even if the State’s Attorney recommends a probation before judgment, the decision is ultimately left with the Court to determine the sentence.
A judge could decide not to give you probation before judgment and can give you jail time. Recently we represented a client who was arrested for causing an accident after having several drinks. While the State’s Attorney offered probation before judgment, the Court refused to grant a PBJ due to the aggravated circumstance. The Court stated that this mistake caused an accident, and could have cost someone else their life. We were able to argue to the judge why jail time should not be given, why if certain conditions were followed our client could have subsequently obtain a DUI. Several months later, after all the conditions set by the court were met, we were able to convince the Court to modify the finding and grant out client probation before judgment.
