An individual contacted our office after having shoulder surgery. This person began having a sharp pain in their forearm leading down to their hand. They voiced concerns to their doctor about this pain and was assured that it was just an after effect of the recent surgery.

The person continued with their physical therapy and home exercises, hoping that things would soon get better. Unfortunately for them, things did not get better. As a matter of fact, this individual's hand began to give them serious problems and they decided that it was now time to speak with a Maryland medical malpractice attorney due to their continued pain.

We were able to get our client's medical records. What we discovered in the records was that our client had experienced a bad accident almost a year earlier, in which the forearm and hand could have been injured.

Add to this, after examining the surgical notes and procedures, there was no evidence that the surgeons departed from the standard of care in our client's surgery. In addition, in the informed consent in which our client signed, nerve pain and injury was a risk associated with the type of surgery that our client was undergoing.

You think that you are the victim of medical malpractice but you are not sure if you are supposed to pay for your medical expert's opinion or your attorney. Who pays ultimately? To understand this issue you must look to your fee agreement with your attorney.

The reason this is the case is because your fee agreement will govern how costs are dealt with in your case. Because the payment of medical experts is deemed a "cost," the fee agreement will indicate who picks up costs.

You must understand costs because some attorneys will make you repay costs regardless of whether you "win" your case. So if your attorney pays for a medical expert and requests your medical records, and then through investigation determines that your case may not be successful, if your fee agreement indicates you repay costs regardless of whether your case is successful or not, this attorney may bill you for the expert and medical records fee.
