On August 21, 2019, Judge Shalina Kumar of the Oakland County Circuit Court ordered Schuyler Bates to pay his ex-girlfriend $100,000 for falsely telling her on April 1, 2018, via text messages that Mr. Bates had secretly recorded sex videos of the two of them together while they were dating and that he had published them onto a pornography website—without the girl’s knowledge or consent—where they had been viewed hundreds of thousands of times. Mr. Bates sent the text messages to his victim not long after she had ended their dating relationship.

The lawsuit was filed by Attorney Kyle Bristow on behalf of the young woman on April 29, 2018.

To date, Mr. Bristow has achieved $500,000 and $600,000 judgments and confidential settlements of significant amounts against men who engage in revenge pornography against their ex-girlfriends, and these are believed to be the first and only revenge pornography cases litigated in Michigan’s legal history. Revenge pornography occurs when a jilted ex-lover posts onto the Internet the content of “sext messages” without the victim’s consent.

The case involving Mr. Bates, however, is uniquely different than a typical revenge pornography case insofar as Mr. Bates did not in fact create or even post any intimate content onto the Internet; he only told his victim that he had done so. This appears to be the first time in American legal history—much less Michigan legal history—that someone was successfully sued for merely telling someone that they had engaged in revenge pornography when they had not in fact done so.
