I always knew that I wanted to use my law degree to help people in need. After moving from Toronto to Detroit, at the peak of the recession, I saw that the community of Detroit was in a real need. Hard-working people were now losing jobs and living off of credit cards just to get by. People in Detroit who could not afford medical insurance had medical bills that were piling up. These people just needed a break, a second chance, to get their life together again and start fresh. I knew then, that I wanted to commit my life to help my community out of this tough time and give them that second chance that they desperately deserve. What is Chapter 13 Bankruptcy?

Chapter 13 Bankruptcy is for individuals with regular income to pay back their creditors based on how much they can actually afford. The debtor proposes a plan to the court detailing how much will be paid to each of the creditors. Once that plan gets approved by the judge, the debtor makes one monthly payment to the trustee for either 3 or 5 years and that payment will be distributed to the creditors.

How is Chapter 13 different than Chapter 7 bankruptcy?
The main difference between chapter 7 and chapter 13 is that under chapter 7, the debtor’s nonexempt property (if any exists) is liquidated to pay off any of the debtor’s debts, while in most chapter 13 cases a portion of the debtor’s future income is used to pay off as much debt as possible considering the circumstances.

Practically speaking, under chapter 7 the debtor loses all or most of his or her nonexempt property and receives a chapter 7 discharge, which completely removes most of the debts. Under chapter 13, the debtor usually gets to keep their nonexempt property, and must pay off as much of their debts as the court deems feasible. Afterwards, they receive a chapter 13 discharge, which is broader than a chapter 7 discharge and releases the debtor from liability for several types of debts that are not dischargeable under Chapter 7.

However, a chapter 13 plan normally lasts 3 to 5 years while a normal chapter 7 only lasts around 3 months. Additionally, a chapter 13 is almost always more expensive for the debtor.

How long will my repayment plan last under a Chapter 13 bankruptcy?
This all depends on your income. If your monthly income is greater than the median income for a family of your size in Michigan then your plan will last 5 years. If your monthly income is less than the median income for your household size then your plan may only last 3 years.

What are some of the advantages of filing a Chapter 13?
One of the greatest advantages of filing for chapter 13 bankruptcy is that you can save your house from foreclosure.
Chapter 13 also allows you to pay back your delinquent mortgage payments over the course of the bankruptcy.
Last but not least, you will have no more direct contact with the creditors. You will make one lump sum payment to the trustee which will then be distributed to each of the creditors. This will give you some peace of mind in not having to deal with annoying collection phone calls anymore.

What is the procedure for filing Chapter 7 Bankruptcy?
First we meet for a free consultation. At the consultation we will discuss if bankruptcy is a good option for you. If we determine that you qualify for Chapter 7 and that bankruptcy is the best option for you, we will give you some forms to fill out and tell you what documents are needed from you. Once you fill out the forms and bring in the required documents, we can have your bankruptcy filed within a week or two. You will also need to attend a meeting of creditors approximately 1 month after we file the bankruptcy. After that meeting, we wait another 60 to 70 days and you will receive the discharge papers in the mail.

After this, you’ll have to fill out form 23, a certification of completion, showing that you took these courses.
4. During this time, you’ll also have to start unwinding your debt, which simply means giving back the things to the people you owe money you said you will in the documents you submitted.
5. You will then have to attend a meeting of creditors in court approximately a month after you, or you and your lawyer, file for bankruptcy. This sounds formal and scary, but a meeting of creditors is simply where a judge (a trustee) will ask you questions about your situation which you already filled out in the forms. By now, you should know the answers to these questions. The judge may invite some of the people you owe money (your creditors) to come to the meeting as well, but it’s unlikely that will happen. Your lawyer will help you prepare for this meeting, and they’ll likely attend to cheer you on!

6. Congratulations! After 60-70 days, the court will make their decision and issue an order of their decision.
