WHAT IS A "TRICK-ROLL" IN A PROSTITUTION SCENARIO?

A "trick-roll" is the common term for a type of theft where a prostitute steals from a "john" in Nevada. Often this happens in Nevada casino hotel rooms, and the hooker steals the customer's cash, chips, or watch.

Sometimes the prostitute commits robbery (using force or fear to steal); robbery is codified under NRS 200.380. Other times the prostitute may steal from the John while he is sleeping or turned the other way; this is called "larceny from a person" or "grand theft person," and it is codified under NRS 205.270.

Depending on the circumstances, trick-rolling carries a penalty of up to 15 years in Nevada State Prison.

NRS 199.220 prohibits willful destruction of evidence in Nevada. Examples include destroying accounting records if you are being investigated for fraud, or erasing files relevant to a criminal investigation.

In Nevada sex offense cases, consequences may include not only having a felony conviction and prison but also having to register as a sex offender. NRS 179D sets forth the Nevada Sexual Registration system under Megan's Law.

Nevada sexual registry laws require anyone who's convicted of a sex offense in Nevada to register as a sex offender within 48-hours from his/her release from custody. WHAT IS NEVADA'S LEGAL DEFINITION OF 'RESISTING ARREST'?

NRS 199.280 regulates resisting arrest in Nevada. It encompasses conduct such as resisting, obstructing, or delaying an officer in the execution of an arrest in Nevada.

Resisting arrest can be a misdemeanor in Nevada where the suspect physically resists the officer without use of a firearm. Misdemeanor resisting arrest in Nevada carries up to 6 months in jail and/or up to $1,000 in fines.

Resisting arrest can also be a felony in Nevada where the suspect uses a firearm. If the suspect uses his/her own firearm, it is a category D felony carrying up to 4 years in Nevada State Prison. PROBATION VIOLATION HEARINGS IN NEVADA:

At a probation violation hearing in Nevada, you have the same rights that you would have at a trial except that a Nevada judge, not a jury, makes the decisions. You have the right to confront and cross-examine witnesses in Nevada, to subpoena witnesses or evidence on your behalf, to testify, and you have the right against self-incrimination.

A major difference between a Nevada trial and a probation revocation hearing is that in a trial, the standard of proof is proof beyond a reasonable doubt. In contrast, the standard of proof for a Nevada probation revocation hearing is a preponderance of the evidence. So even evidence that is not very strong but that tends to show you violated probation may be sufficient to result in a violation of your probation in Nevada.

If your probation is violated in Nevada and it is a felony, the judge may send you to state prison. If the judge had imposed a suspended sentence when you were originally convicted, the judge may un-suspend the sentence. If it is a gross misdemeanor, the Nevada judge may send you to jail for up to 364 days. If you are willing to admit that you violated the terms and conditions of your probation in Nevada, and if your attorney can negotiate with the prosecutor, you may be given a lesser sentence.

If a person has come close to satisfying the terms and conditions of their probation in Nevada, and he/she picks up a violation near the end of their probationary period, the judge may simply just agree to dishonorably discharge the probationer without the imposition of additional sanctions or prison time. The downside is that a dishonorable discharge from probation in Nevada will prevent you from ever being able to seal your criminal record for that charge.

CAN I GET A NEVADA DUI CASE DISMISSED?

If you have been charged with a DUI in Nevada, there are a number of ways that the case could be dismissed. For example if law enforcement did not property maintain or calibrate its breath-testing devices, if the individuals who administered or tested your blood weren't property certified, if your blood tests were contaminated, if your blood or breath test was not taken within two hours of the driving, or if you have a medical condition that would give a false DUI reading, then it may be possible to persuade the prosecution to dismiss the DUI charges in Nevada. Additionally, the D.A. may be willing to reduce DUI charges to a lesser offense in Nevada if you have no history of DUIs.

CAN I WIN A NEVADA DUI CASE AT TRIAL?

A defendant facing first- or second-time misdemeanor DUI charges (within seven years) does not have the right to a jury trial in Nevada. Instead, a Nevada judge decides the case. The defense attorney should then do everything possible to vet the merits of the Nevada DUI case. Examples include seeing if the breathalyzer was defective, or to do a blood split, which is an independent lab test to see if the blood test results were inaccurate.

The best option would be to challenge the DUI before trial by filing motions that could result in the dismissal of the charge in Nevada. But if the defendant has strong issues in his/her favor, it may be in his/her best interest to go to trial and let the judge decide whether the D.A. can prove guilt beyond a reasonable doubt in Nevada.

The decision as to whether to go to trial for a Nevada DUI charge would be contingent on the facts of the case and who the judge is. But under the right circumstances, you can take a Nevada DUI case to trial and win.

IF I'M A TOURIST, WILL I HAVE TO RETURN TO NEVADA FOR MY DUI TRIAL?

Most of the time, Las Vegas Defense Group, L.L.C., can resolve out-of-town clients' DUI cases with minimum DUI penalties, a charge reduction or a dismissal without them ever having to come back to Nevada to appear in court. If the case goes to trial however, it may be necessary for defendants to be present in Nevada.
