Jessica Peraza is an associate attorney working with the firm’s estate and elder law department. Barbara Howe in Erie County Surrogate’s Court and worked in the Public Benefits Unit of Neighborhood Legal Services. Ms. Peraza attended St. Lawrence University in Canton, New York where she graduated with a B.A in Spanish Language & Literature and Government. While at St. Lawrence, Ms. Peraza spent a semester abroad in Madrid, Spain. Ms. Peraza graduated cum laude with a J.D. from SUNY Buffalo Law School in 2015.

What will happen to your estate if you don't have a Will?

If you do not have a Last Will and Testament, the rules of intestacy will govern the distribution of your estate. If you have a spouse but no children, then the estate passes to the surviving spouse. If you leave a surviving spouse and children, the first $50,000 plus one-half of the remainder will pass to your spouse and the other one-half in equal shares to the children. If you have no surviving spouse or children, then your estate passes to your parents or your parents' descendants.
