If you are arrested for common law DWI (NYS VTL 1192 (3)) or show positive for alcohol on a roadside breath test the police can make a lawful request of your body fluids.
A refusal to give a sample of your breath or blood after a request by a New York State Trooper, police officer, or deputy will eventually lead to a REFUSAL Hearing. In New York State the criminal process of a how a case progresses can be confusing at times. Knowing what happens (or is supposed to happen) at each and every stage can be comforting. Stage one is called the initial appearance (arraignment) but stage two is called the PTC (pre-trial conference).

My number one job is to protect my clients. Avoiding jail or a long term of county probation supervision and monitoring is part of that protection. I do recognize the value of probation, and when it is appropriate, the services of a probation department can be invaluable to help people.
As an alternative to incarceration, probation supervision allows people to remain gainfully employed, remain with their families, get mental health counseling, and get treatment for their drug/alcohol issues. Probation is a form of supervised release.
These are just some of the "terms and conditions" of a three year misdemeanor or five year felony probation:
1. Report to a Probation Officer or have the Probation Officer make surprise (unannounced) visits to your home or elsewhere (perhaps your job).
2. Remain within the State unless granted permission to leave (No random visits to relatives or friends or potential job opportunities in other states).
3. Be available for questions from your probation officer.
4. You must receive permission (prior consent) from your Probation Officer before you move, change your job, or remain away from home past 12:00am.
5. Refrain from disreputable people or places.
6. Abstain from the use of all drugs (except by prescription), as well as the use of any intoxicating beverages (alcohol).
7. Stay away from all places where (intoxicating beverages) they are sold or served for on-premises consumption. In other words bars, taverns, and even some restaurants that are really "bars with food."
8. You must submit at any time without notice and without a search warrant to a search of your person, residence, vehicle, or other personal property, leased and/or owned that is not your residence and any area under your immediate control and permit seizure of any contraband.

The DMV Refusal hearing is limited to the following issues:
1. Did the police officer have reasonable grounds (PC) to stop your car?
2. Did the police officer make a lawful DWI arrest?
3. Were you given sufficient warning, in clear and unequivocal language, prior to refusal that the refusal to submit to such chemical test would result in the immediate suspension and subsequent revocation of your license or operating privilege whether or not you were found guilty of the charge for which the arrest was made.
4. Was your refusal to submit to such chemical test persistent?

The Chemical Test Refusal DWI Case is unique for a number of reasons.
First the positives of the refusal case:
1. The prosecutor can only charge VTL 1192 (3), "Common Law" DWI.
2. The prosecutor usually only has one main witness, the arresting officer.
3. The prosecutor must prove that "you were mentally and physically incapable ( to a substantial extent) of operating an automobile as a reasonably prudent driver."
4. They must prove this legal burden of "intoxication" beyond a reasonable doubt based upon the police officer's observations, and field testing, if any.
5. The DWI defense lawyer can cross examine the police officer at the DMV administrative hearing without the presence of the prosecutor.
Second, the two main negatives of the refusal case:
1. You will have NO license of any type (conditional or hardship) while your criminal case is pending. NOTE: unless you win at the administrative refusal hearing (unlikely) or the officer does not show for the hearing and it is re-scheduled.
2. The jury will get an instruction from the Judge that they may infer a Consciousness of Guilt from your choice to not take the chemical test.
