What can be done?

At the Worden Law Firm, we believe everyone deserves a clean slate after they have paid their debt to society and definitely if they were found not guilty or had their case dismissed. This is why we stay informed of Oklahoma expungement law, making sure we know every legal angle to obtain an expungement of criminal records for our qualifying clients.

Not every record or criminal act will qualify for expungement. Even juvenile records or a misdemeanor don’t disappear without seeking for an expungement. This is why, when defending our clients, we do our best to make sure the outcome of their case is favorable to an expungement.

What kind expungements are available?

Oklahoma has four different types of expungement available. They include:

22 O.S. §18/19 – Full record expungement
22 O.S. §991c – Expungement upon successful completion of a deferred sentence
22 O.S. §60.18 – Expungement of a Victim’s Protection Order
10A O.S. §2-6-109 – Expungement of Juvenile Records
Option #1 (22 O.S. §18/19) is obviously the best choice if you qualify. By having your full record expunged you won’t show up in any background search by an employer or other agency. This type of expungement also allows you to legally deny the arrest.

Option #2 (22 O.S. §991c) may be a good option if you don’t qualify for option #1. It doesn’t seal all of your court records and arrest records but upon successful completion of your deferred sentence your record can be updated to read that you pled not guilty and that the case was dismissed and public records will be closed.
