3. SOUNDBITE (English) Harry Schneider, civilian defence attorney:
"As of this afternoon, or this evening, the court is still considering taking on the responsibility that we've invited him to take on to make a determination under the Geneva Convention whether this detainee is entitled to POW status. If so, then he is not eligible for trial by military commission."

"As for as the process itself, I think it's an outstanding success. The defendant had five defence attorneys who argued very well, who found issues that no one had really anticipated. Even the process going back, the judge dismissed the case initially, showing the judicial independence of the military judges in this system."
8. Medium shot of guard and detainee in recreation area, Camp 5
9. Medium shot of Commissions building.
10. SOUNDBITE (English) Harry Schneider, civilian defence attorney:
"If Mr. Hamdan is subject to a determination of whether he was an unlawful or lawful enemy combatant, it's relevant evidence if somebody, so to speak, on the inside is willing to talk about whether Mr. Hamdan was so engaged. It's not a difficult theory...it's you know people who were actively involved unquestionably are in a much better position than me or you or anybody else in this room."

STORYLINE
Witnesses on Thursday are expected to take the stand for the first time since the US government began attempts to prosecute terrorism suspects at Guantanamo.
An expert in Middle Eastern affairs is expected to testify for Salim Ahmed Hamdan to support the defence argument that he could have been a driver for bin Laden without being an devoted al-Qaida member with knowledge of terror attacks.
Prosecutors are expected to present about five witnesses to back their case that Hamdan should be charged as an unlawful enemy combatant, in the second day of pretrial hearings to determine whether the military tribunal at the isolated Navy base has jurisdiction over the case.
Meanwhile, a military judge at Guantanamo on Wednesday rejected a defence request to talk to the alleged mastermind of the September 11 attacks and two other so-called "high value" detainees to bolster their case that Hamdan was at best a minor al-Qaida figure.
Civilian defence attorney Harry Schneider told reporters that he had hoped that Khalid Sheikh Mohammed and the two other high-value detainees held at the US military base could establish that their client was not a terrorist.
"People who were actively involved unquestionably are in a much better position than me or you or anyone else in this room ... to say what Mr.
Hamdan was," Schneider said.
In denying the request at least for now, the judge in the case said more time would be needed to overcome the "security obstacles" posed by meeting men accused of some of the world's worst terrorist attacks.
Hamdan's lawyers wanted to show he does not meet the definition of an unlawful enemy combatant and is therefore not eligible to be prosecuted by a military tribunal.
including the alleged architect of the September 11 attacks.
