For more than 29 years, Stuart A. Carpey has worked exclusively in the area of protecting the rights of people injured in accidents. He graduated from the University of Maryland in 1983 and from the Villanova University School of Law 1987. He is the lead attorney at his firm, focusing his practice on complex civil litigation, which includes representing severely injured plaintiffs in a vast array of personal injury cases. He also represents individuals and small businesses in disputes involving insurance claims. He is a member of the Million Dollar Advocates Forum, whose membership is restricted to attorneys who have secured million-dollar settlements or verdicts. He is a nationally known lawyer, speaker and educator in the area of personal injury law and law practice management. How Are Personal Injury Cases Resolved?- Carpey Law
How is a personal injury case negotiated? There's really only 3 ways that a personal injury case can be resolved by way of trial, mediation, or negotiated settlement.

What happens in a negotiated settlement? Typically what happens is the opposing insurance company comes to the settlement table with a figure that's much lower than the settlement value actually is. We come to the settlement table with a figure much higher than we believe the settlement is. Slowly both sides try and reach a negotiated settlement to settle the case. This process can take months to years. In fact, it can continue throughout litigation all the way up to the trial of the case. This is how a negotiation is conducted in Pennsylvania.

Uninsured motorist coverage means that if the person who caused the accident does not have insurance coverage, as long as you purchased uninsured motorist coverage, you have a right to make a claim for personal injuries through your own insurance company.

Underinsured motorist coverage means that if the person that caused the accident doesn't have enough insurance coverage to cover your damages and injuries, you have a right to make a claim through you own insurance company for the additional coverage. What is a mediation in a personal injury case? Why would a personal injury lawyer in PA agree to a mediation?

A mediation is an opportunity for both sides in a lawsuit to meet with an unbiased mediator. Typically, a mediator is a retired judge that now holds mediations and conducts the entire mediation. So what happens during a mediation of a personal injury case? It's not necessarily a trial but rather an opportunity for both parties in a lawsuit to come together and speak with mediator both together and sometimes privately.

So what happens in a mediation is the mediator tries to force a settlement but recognizing the strengths and weakness that are posed on both sides of the lawsuit. Sometimes it's successful, sometimes it's not. Usually, it's a good idea to attend a mediation pre-trial because you can gain insight into what information the other side has. At the same time, you have to release some information that you plan to use in trial. Overall, a mediation in a personal injury case is a good opportunity to try and settle the case before it goes to trial.

What kind of personal injury cases should go through mediation? Some personal injury cases are good for mediation and some aren't. Determining whether your case is a good case to go through mediation depends on the circumstances of your case, the types of injuries and depends on whether the opposing side is willing to mediate the case.
