How Much Does it Cost to Hire a Personal Injury Lawyer? | Contingency Fee Agreements
What does it cost to hire a personal injury lawyer? In most cases, it will cost nothing to sign up and hire a personal injury attorney for your car accident case.

Personal Injury Attorneys work on a Contingency Fee basis. This means that the attorney will not charge anything until a settlement or trial verdict is won.

A client and lawyer will agree upon a percentage of the settlement or jury verdict award to be paid to the attorney at the conclusion of a case.

It's important to take time to explore your options after a serious car crash. After seeking medical care, consult with an attorney and ask if they represent clients on a contingency fee basis.

Howdy Y'all!

McMinn Law Firm presents:
The Austin, TX guide for recovery in your truck accident personal injury case

You've got questions:
What should you do immediately after a crash?
What are common causes of semi-truck accidents?
How is a truck accident different from a car accident?
Why should you hire a lawyer?

We've got answers!

What should you do immediately after a crash?
1. Seek Medical Attention
- Your ability to recover often hinges on whether or not you seek care right after the crash.
- Although clients often fear the costs of medical care, health and well being should come first after a serious wreck.
- A gap in care may cast doubt on the authenticity of injuries during the crash.

2. Move to a Safer Location
- If there are no serious injuries, move out of the way of traffic.
- Don't move anyone who is seriously injured unless you are trained to do so.

3. Contact Authorities
- Call the police even if both drivers agree on fault in the crash. That way they can't change their story later.
- Getting a police report helps ensure the facts of the crash are recorded.

4. Collect Evidence
If possible: take photos of injuries, vehicles, and the scene of the crash.

What are common causes of semi truck accidents?
Truck Driver Fatigue - Federal regulations limit the hours a driver can spend behind the wheel. Drivers sometimes exceed the 14 hour limit.

Improper or Lack of Maintenance
Trucking companies are responsible for regular maintenance on all aspects of the vehicle. Long hauls can strain any faulty equipment or maintenance.

Truck's Size May Increase Harm
Many of the common reasons car accidents occur can affect truck crashes - but the consequences could be greater.

How is a truck accident different from a car accident?
In truck accidents, there are many different parties that can be responsible for paying out compensation to victims.

A truck accident lawsuit could involve:
- The owner of a rig
- Manufacturer of Parts
- Owner of the Freight
- Party responsible for the truck's maintenance
and
- Trucking Company

Why should you hire a truck accident lawyer?
1. Hiring an attorney gives you the advantage of having an experienced negotiator on your side.
2. Most personal injury lawyers work on a contingency fee basis. The lawyer agrees to accept a fixed percentage of the settlement. They don't get paid unless you do.
3. Avoid legal red tape. You can skip a maze of paperwork when you hire an attorney. The legal staff at a law firm is skilled in navigating the claims process.
4. Possibility for a better settlement. An attorney's job is to negotiate a maximum fair settlement. If a case doesn't need to go all the way to trial, settling can save clients emotional and financial costs. An attorney will help their client decide if settling is the best option.
5. Expert representation at trial. An attorney will develop a strategy designed to help you get the compensation you deserve.

Negligence vs Gross Negligence | How Punitive Damages Play Out in Personal Injury Settlements
Austin personal injury attorney Jason McMinn recently won a gross negligence jury verdict in a Georgetown, Texas dog bite case. This information was originally published about the difference between neglignece and gross negligence on McMinnLaw.com.

When the defendant is found to have acted grossly negligent, a jury may find it necessary for them to be punished by paying punitive damages. Those damages can go above and beyond the insurance maximum. One main purpose is to punish the defendant so that they do not commit the gross act again and do harm to others.

https://www.mcminnlaw.com/difference-negligence-gross-negligence/

A Georgetown man was attacked by a dog in his own backyard. After investigation, it was revealed that this wasn’t the dog’s first attack. Dog owners Allen Smith and Patricia Briggs had been aware of the dog’s dangerous behavior since the year before when King had bit a 12-year-old in the neighborhood by jumping over the fence.

At that time, animal control officers conseled the defendants on options to prevent King from jumping up to the top of the fence as well as the need for training for King.

Jury members found the couple negligent and awarded a verdict that included $100,000 in medical expenses as well as $10,000 in punitive damages.

On the verdict, dog bite accident lawyer Jason McMinn said:

“I think the verdict speaks volumes for what the Williomson County Citizens feel about feeling safe in their backyard.

It also sends a clear message that pet owners need to take responsibility when they know they have a dangerous animal and it has previously bitten someone.”

This case involved proving negligence which includes four primary parts:

Duty of Care
Breach of Duty
Factual Causation
Damages
The main difference between negligence and gross negligence is in the impact or severity of the damages. Ask: “how severe was the carelessness?” Punitive damages can act as an additional punishment and send messages in order to prevent others from acting in the same harmful manner.

An injury journal can show pain and suffering during after a personal injury accident.

Police reports help demonstrate fault in a crash. Photos, video, and other evidence from the crash help to illustrate what happened during the crash. Even if you may be partially at fault, you may still have a case. Learn about your options under a legal framework known as "contributory negligence." https://goo.gl/vvJ5QX

102 Reasons to Make A Pledge For Safer Streets | Austin, Texas Traffic Deaths
This 15 second video recognizes the lives lost in Austin, Texas traffic fatalities in 2015. The year set a tragic record as Austin's deadliest year for traffic related fatalities. What can you do to make 2016 safer?

City officials in Austin have created a task force, Austin Vision Zero, made up of Police Officers, members of the Austin Planning Department, and members of the Austin Transportation Department.

Traffic Fatality deaths in 2015 were caused by many factors.
Day of Week: Echoing Austin Police Department (APD) analyses, we found there’s no single most dangerous day on Austin roads. With available information, 16 of Austin’s traffic fatalities occurred on a Saturday, but then again, 15 occurred on a Wednesday.
Time of Day: Fifty percent of Austin’s traffic fatalities occurred between 8pm and 4am, 24% occurred between noon and 8pm, and 20% occurred between 4am and 12pm (for some crashes data was unavailable).
Age of Victim: The average age of traffic fatality victims was 36, and the most often age was 26 (which occurred 5 times).

Most common causes for traffic fatalities were driving while intoxicated or under the influence, distracted driving, walking while under the influence, and failure to wear proper safety gear while operating a motorcycle or failure to cross at a crosswalk.

Austin Vision Zero Task Force hopes to create safer conditions for pedestrians by increasing the number of dedicated crosswalks and sidewalks in Austin. Many car-pedestrian injuries occurred at one of five dangerous intersections identified by data-driven analyses.
While the city and task force wrestle through the official recommendations, Austin drivers can begin fighting traffic accidents immediately by choosing not to drink and drive and driving cautiously for potentially dangerous conditions such as darkness and weather.

Learn how you can make Austin streets safer, and how the city plans to address traffic fatality and injury woes:

100 Percent Too Many: Austin, TX 2015 Traffic Deaths
More than half again as many people died in Austin, TX car accidents in 2015 than in 2014. This 30-second video by McMinn Law Firm compares accident types between the years.

Austin traffic continues to grow in 2016. Several factors are at play. There is a growing population in Austin. The population is growing naturally, and some sources say that 100 people were moving to Austin in 2015. With gas prices as low as two decades previously, more Austinites are out on the roads. Data trends show that East Austin neighborhoods are gentrifying, pushing low income families farther East, and out of service zones from public transportation. Now, many low income individuals are commuting to work using a vehicle instead of utilizing public transportation.

Some experts attribute Austin's record high traffic fatalities to the core structure of the city. Critics encourage drinking in neighborhood bars where walking home is a viable option.

Many of the pedestrian fatalities in 2015 occurred on dark, high speed roads in which the pedestrian was not legally crossing at the crosswalk. City officials are looking to increase crosswalks in the city, and seeking out other initiatives.

Austin city officials have addressed the issue by forming a task force. Austin Vision Zero provides recommendations to the city on how to reduce traffic fatalities.
