Stewardship of Sisterhood
With the celebration of Mother’s Day this week, certainly a tribute that is memorialized in other fashions throughout the year, stories often come to the forefront of one’s mind that speak to the special bond shared between many a mother and daughter.

As an Estate Planning and Elder Law Attorney, I am so thankful for the knowledge imparted – mostly shared by those with wisdom gained from years of practice. Often a combination of knowing the law and what some may call “street smarts.” There is no substitution.

Life Hope Care Assets The Complete Story
Recently, I was asked to present during a community gathering, addressing two aspects. The first, being what are the most prevalent challenges faced by most of my clients. The second, to talk about what the older adult generation contributes to our community. Here are the summarized comments related to Elder Law & Estate Planning in the Commonwealth of Virginia, April, 2019.

Advance Medical Directives Why Now Why Not
In § 54.1-2983 of the Code of Virginia, USA, the procedure for making an advance directive is set forth. “Any adult capable of making an informed decision may, at any time, make a written advance directive to address any or all forms of health care in the event the declarant is later determined to be incapable of making an informed decision.”

As an estate planning attorney, I am frequently afforded a glimpse into the private lives of clients seeking to prepare for the threshold of death. I treasure the sharing of the fears, struggles, and celebrations. Though most of my clients are older adults, as those under fifty seem not to understand how quickly the years may pass, or as hard as the reality may be - that they may not have many years in front of them.

There is a common thread that is expressed......

Guardianship Basics & Reality
Attorney, Author, & Podcast Host Katherine S. Charapich, Esq. shares perspective on Guardianship, Capacity, and Powers of Attorney of senior adults in the Commonwealth of Virginia.

"When concerned family or friends begin to notice a combination of challenges faced by a loved one, such as: denial of a medical diagnosis, discounting poor living conditions, acts of ignoring financial commitments, not seeking medical treatment when such action is imperative to one's health, inability to understand one's surroundings in a manner that warrants the assistance from others, a susceptibility to exploitation (like scams), and a victim of neglect without the wherewithal to change one's circumstances - seeking legal counsel is wise." ~ Behind the Photo - Road to Guardianship.

What can be shared is that there was no devise or bequest to any of the children. And, when the nondescript piece of furniture was delivered to the neighbor, inside a drawer was a key with a note attached.

Who Would You Trust? An Estate Planning Matter?
Who would you Trust? Estate planning documents that reflect the beauty of a relationship . . . A husband recognizing the beauty of motherhood, the loveliness in his aging bride, and the desire to make sure she has protective, estate planning documents in place, seems an appropriate tribute that this day and every day is Mother's Day.
