Attorney Thomas B. Burton discusses the question: "How to Leave a House Bought With Inheritance Solely to My Kids" in a situation where the questioner wants to leave the house to her kids only and not to her husband or any future spouse he may remarry. In this Real Attorney Reacts series, Attorney Thomas B. Burton analyzes a question dealing with inherited money and the purchase of a house with that money. In this episode, the letter writer says she was talked into putting her husband's name on the title to the house before the closing. Now she wants to know how she can leave this house to her children upon her death, but allow her husband to live in the house for the rest of his life. She ultimately wants the house to go to her children as an inheritance and not go to her husband, or to her husband's family if she predeceased her husband. Does a Will Avoid Probate in Wisconsin?
In this video, Attorney Thomas B. Burton answers the following question:
"Does a Will Avoid Probate in Wisconsin?"

Attorney Burton discusses what creating your own Last Will and Testament in Wisconsin means and he discusses some things a Will accomplishes and other things it does not. One of the confusing aspects about this term "probate" is that many people mistakenly think that making a Will means they will avoid probate. Instead it is just the opposite. A Will ensures the assets passing under your Will=WILL go through the probate court process. Forming a Will in the state of Wisconsin is not enough on its own to avoid probate. There are multiple ways to avoid probate in Wisconsin, but you need to use other estate planning tools, such as a revocable living trust, also known as a revocable trust or a living trust to help you accomplish those goals. A Will alone is not enough to completely avoid the government run probate court system for most people.

CARES Act - New Charitable Contribution Tax Deduction
Attorney Thomas B. Burton discusses the special new charitable contribution tax deduction for taxpayers in 2020 due to the passage of the CARES Act in the spring of 2020. This new $300 charitable deduction allows taxpayers to take a tax deduction for cash contributions made to a qualifying charitable organization in 2020. Taxpayers can take this deduction even if they do not itemize and instead take the standard deduction.

Helping Senior Americans with Elder Law Planning During COVID-19
Attorney Thomas B. Burton discusses helping senior Americans with elder law planning during the COVID-19 pandemic and talks about the special challenges that senior citizens are encountering during the ongoing COVID-19 pandemic in the United States due to the social distancing measures currently in place at many institutions to help stop the spread of the COVID-19 virus. Attorney Burton discusses several ways that friends, relatives, and family can help these senior citizens during this time. Attorney Burton also discusses the importance of elder law planning during the COVID-19 pandemic and talks about the key legal documents every senior American should have in place as part of their comprehensive estate plan.

In addition, Attorney Burton discuss stories he has heard from his own estate planning law practice about some of the measures hospitals and nursing homes are taking during this time due to the virus, measures which can mean that seniors are often isolated and alone with limited means to communicate outside of their nursing home or hospital. How to Make a Will During COVID-19 -Estate Planning Attorney Explains
Estate planning attorney Thomas B. Burton discusses how to make a Last Will and Testament during the COVID-19 global health pandemic in this video. Attorney Burton discusses two methods he recommends for getting a Will put in place during the COVID-19 crisis and one he doesn't, and as a bonus he discusses a fourth option that can be even easier than the requirements needed to make a Last Will and Testament.

Many attorneys are using remote video meetings and social distancing protocols to both meet with clients and get their documents signed during the COVID-19 pandemic. Attorney Burton discusses these measures and provides viewers with practical tips on how to find an attorney who can work with them remotely and get their documents signed and witnessed during this time. In addition, Attorney Burton discusses a DIY option for folks who need a basic Last Will and Testament very quickly, either because they have been diagnosed with COVID-19 and cannot leave the house, or because they have some other serious health concern and do not have time to meet with an attorney. This option works well for people with small or modest estates. Finally, Attorney Burton covers a bonus option that is even easier to sign and form remotely during the COVID-19 pandemic, whereby people can avoid probate and avoid using a Last Will and Testament as the main vehicle for their estate. In many states, individuals can sign a trust without the requirement that witnesses be physically present in the room when the person making the trust, the Grantor, signs the document. Attorney Burton discusses how you can get a Trust put in place for your assets, entirely remotely, through the use of remote video meetings, and signing the appropriate documents according to the directions of your attorney. Attorney Burton also discusses the remote notary option and remote witnesses options that some other states have put in place during the COVID-19 pandemic. Finally, although Wisconsin does not currently allow remote notarization or remote witnessing of estate planning documents, Attorney Burton discusses some creative options for getting your estate planning documents signed, witnessed, and/or notarized by a Notary Public during this time.

Can You Own a Car on Medicaid?
Attorney Thomas B. Burton answers the following question:
"Can You Own a Car on Medicaid?"

Attorney Burton discusses the qualification rules in order to receive Medicaid assistance to pay for Long Term Nursing Home Care in the state of Wisconsin through the Medicaid program. Medicaid is a need based program, and qualification depends on the amount of assets you currently own. One of the assets Medicaid will ask you about if/when you apply for Medicaid is whether you own any automobiles (cars) and if so how many? You are required to report the number of cars you own that are titled in your name on the Medicaid application on the date you submit your Medicaid application. Medicaid is a federally funded program that is administered slightly differently in each state. Attorney Burton discusses the rules for qualifying for Medicaid assistance in the state of Wisconsin and also discusses the difference between an exempt and non-exempt asset for the purpose of applying for Medicaid assistance in Wisconsin.

I'm Attorney Thomas Burton and today's question is the following:
“Which is better, revocable or irrevocable trust?”

So the answer to this question is, it depends. It really depends on what you're looking to do with your trust, whether you want the revocable or irrevocable trust. An easy way to think about it is this, revocable trusts are changeable during your life. So they are the most common type of trust we use as what we call a will substitute. We use a revocable trust to avoid probate upon all your assets upon death and avoid the time delay and expense of a court-ordered probate process.

Now, an irrevocable trust can do the same thing - avoid probate but we generally use irrevocable trust for asset protection. When we put an asset in an irrevocable trust, we're saying we can no longer change the trust, essentially that asset is no longer ours. It's owned by the trust and the asset must be administered according to the rules we wrote in the trust, usually by an independent third party trustee, someone you choose to be trustee, not yourself.

So we use irrevocable trust for asset protection. You can think about protection from creditors, nursing homes, the state of Wisconsin Medicaid Program Etc. And the other situation you'll see an irrevocable trust use is for estate tax planning. Now, these are used less for that outside of the very wealthy, if you have under $11.2 million per individual, you probably aren't going to look at this type of trust in terms of being worried about estate tax, but they are very, helpful the irrevocable trust, for asset protection.

So again, think of it this way, not which is better but what type of planning I'm trying to do. If I want to avoid probate, have privacy upon death, provide for the instance where I may need a court ordered guardianship instead of a guardianship. I have a trust in place. The best option is a revocable living trust. If you want to add asset protection, creditor protection, long-term nursing home care planning, then you're going to want to look at an irrevocable trust and talk with your lawyer about the type of planning you want to do, so they can put together the right type of trust for you. At my office, we use both types of trusts. Sometimes together, sometimes alone. It depends on your specific situation.

This Wisconsin Basic Will is suitable for people of modest means, limited assets, and non-complex family situations. It may not be suitable for individuals with children from a previous marriage (blended families), or business owners. Please read carefully the instructions and notices provided by the Wisconsin Legislature at the outset of this Basic Will form before deciding whether it is right for you and your family situation. My goal in creating this video, is to help folks with modest means who are unable to hire an attorney, or folks who may be trapped inside their homes and need a Will very quickly. These Wisconsinites can now easily create a Basic Will by following this video as I walk you through the steps laid out by the Wisconsin Legislature.

I suggest printing out the paperwork, and then playing the video section by section, and pausing it after I speak about each section that you need to complete, then continue the video when you have completed that section. In this way you can complete the whole Basic Will along with me as I walk you through the various sections. I also suggest pausing the video near the end when I talk about the proper way to sign the Will in front of your two disinterested witnesses, and then playing this video with your witnesses before you physically sign the Basic Will in front of them. Parents Died from COVID-19 - No Wills - But Left Emails for Me to Inherit Home. Is this Legal?

Attorney Thomas B. Burton discusses one of the most valuable tax deductions available to homeowners when they sell their home and discusses how the recent changes to the tax code enacted into law for 2018 apply to this valuable home sale tax exclusion. There is a $250,000 home sale tax exclusion available per person for your principal residence and if you are married you can double it to $500,000 and potentially shield $500,000 in capital gains on your principal residence from any capital gains tax when you sell it. This is one of the best legal tax minimization strategies out there, but it only works if you know and understand the ownership and use tests applied by the IRS as explained in this video.
