Nevada Lemon Laws

Whether you purchased a truck to haul lumber or a sedan to get you to work the last thing you want from your new car is old car problems. If your brand new ride is spending more time sitting in the shop than roaring out on the open road, you may have a "lemon" on your hands. Lucky for you, the Silver State has legal protections for new car purchasers. Here is a quick introduction to “lemon laws” in Nevada.

State Lemon Laws

State lemon laws are intended to offer some financial protections for new car buyers as well as encourage manufacturers and dealers to provide a reliable product. Although some lemon laws in other states cover used vehicles, Nevada’s lemon law applies only to new cars under warranty.

Lemon Laws in Nevada

Nevada’s lemon law statutes are listed in the table below.

Code Section

Nevada Statutes 597.600, et seq.: Automobile Repairs to Conform to Express Warranties

Title of Act

Not specified

Definition of Defects

Nonconformity to all applicable express warranties which significantly affects the use or market value of vehicle

Time Limit for Manufacturer Repair

Before expiration of manufacturer's express warranties or no later than 1 year after date of delivery to original buyer, whichever is earlier

Remedies

Replace with comparable vehicle of same model having same features; if vehicle cannot be delivered within reasonable time, then a comparable vehicle substantially similar to replaced vehicle or accept return and refund full purchase price including all sales tax, license fees, registration fees, and other similar governmental charges, less a reasonable allowance for consumer's use

Even under Nevada law, not every new car needing repairs will qualify as a lemon. The following general lemon law guidelines can help determine if your new car is a lemon:

  • The vehicle must have a substantial nonconformity that appears within a certain time after purchase;
  • The nonconformity must be covered by a warranty; and
  • The nonconformity must continue to exist, even after a reasonable number of attempted repairs.
