Am I required to keep the at-fault insurance adjuster up-to-date on my injuries?

And the answer is “no.” In fact, the reason the insurance company is so aggressive with contacting you and reaching out to you and sending letters to you is they want information from you and they want to help place a value (and hopefully, the most conservative value on your claim after you’ve been injured). And so, when they speak with you about your injuries they want to know: “Is it serious?” “Is it not serious?” “Is it becoming surgical?” And that helps them value their claim.

It is our recommendation that you do not give them any information until you have completed treatment; as you’re not a doctor, you’re not a medical professional. And if you are, you still want to hold back to make sure you know what the full extent of your injuries are. Once you know the full extent of your injuries, I always recommend that you speak with a Georgia personal injury attorney and discuss the possibilities of resolving a claim at that point—but not until then. So I would recommend that you do not contact the at-fault insurance carrier to update them about your injuries.

Well the short answer is, there is no time limit on them and you must impose a time limit on them. As an attorney we have ways of placing deadlines, that's why it's always recommended you reach out to an Atlanta | Savannah personal injury attorney.
There are cases where sometimes the insurance company may not attempt to settle your injury claim and if that's the case you have certain deadlines in which you have to file certain documents to protect yourself from losing the value of that claim completely and not being allowed to bring that claim forward in the future, it's called a statute of limitations.

And our video topic for today is how can I file a claim or a workers' compensation claim for a work injury I've had. Well as you know probably from the other videos as soon as you're injured the first thing you need to do is report it to your supervisor or boss and ask them for medical care. If they're not responding it's always a good idea to put it in writing and send it to them and either mail it to them certified-return receipt so you know they've received it or fax it to them with a fax confirmation stating that you have been injured on the job, you're hurt and you need medical care as it relates to your claim. Another way to set up the claim is to look for what is called a posted panel of physicians. Some employers have them, some don't. If your employer does not have a posted panel of physicians also called a list of doctors with which you can see if you're injured on the job or you don't know where to locate them, it's probably a good idea to reach out to an Atlanta, Georgia workers' compensation attorney, speak with them about what your rights are and what would be the next step that would be in your best interest to get the medical care you need. The main thing is you never want a statute of limitations to run in any matter, workers' comp, personal injury, any type of matter and so, if you're anywhere close to the original 1 year from the date of injury and you have not retained an attorney, you do not know if there's a claim set up with the Board, State Board of Workers Comp, you're gonna want to contact the State Board of Workers' Comp and find out. Use their claim and fax setup. They have it based on Social Security numbers if you don't know your claim and you will need to give them that information and they'll look it up. If they do not have a claim setup you can speak with them about setting up a claim. It's what's called filing a WC-14. I got hurt at work and then I got fired. Can they do that? Can the employer do that? Can they terminate me after I've been injured on the job? Unfortunately, this is something that we're seeing a lot of, and the specifics of if they can or cannot terminate you are really based on what exactly happened. So you'll really want to reach out to a Georgia's workers' compensation attorney because if they fired you, and it can be proven that it was because of your work injury, then you are entitled to income benefits and, of course, medical benefits for your workers' compensation claim.

If they terminate you, and it's for reasons other than your work injury, such as you didn't show up on time, you were belligerent or talked back to a manager and they wrote you up three or four times, or whatever the policy is for the employer, then they arguably do not have to pay you income benefits or weekly checks, but you still have what's considered a medical-only claim where you can get the medical treatment you need as it relates to your injury, but you will not be able to obtain income benefits if the facts show that it was because of you being difficult to your employer that you got terminated. It depends a lot on what your employer has in place. Your employer if he's subject to the act he or she is subject to the act they are required to provide what's called a posted panel of physicians or a list of doctors of medical providers, I'm sorry, that you can treat with if you're injured on the job. If they do not have this in place there is a possibility that you can see the doctors you wish to see however, it would be important that the doctors also accept patients from the workers' compensation system. Workers' compensation does not pay what you or I would pay out of pocket and therefore, they pay a reduced rate and some doctors are not willing to take on the reduced rate fees provided by the fee schedule of the Workers' Compensation Act. A lot of people get confused as to if they have a workers' compensation claim and/or a personal injury claim and a workers' compensation claim is when you're injured on the job, doing the job you were hired to do. Therefore if you're hurt while you're working you typically have what is known as a workers' compensation claim. Workers' compensation in Georgia is a no fault system meaning you do not have to prove negligence whereas a personal case you would have to prove negligence.
