Prior to that Ms. Saedi worked as a corporate attorney representing technology companies on a variety of issues. Ms. Saedi was responsible for drafting corporate technology policies, preparing domestic and international license agreements and assisting companies with day to day counseling on all business related matters. Ms. Saedi has tried numerous matters before the bankruptcy courts in the Northern District of Georgia involving creditor actions to enforce foreclosure sales, debtor’s objections to creditor claims, motions for sanctions regarding creditor abuse and various other matters. Ms. Saedi has also been a lecturer on bankruptcy issues and speaks to community and corporate groups regarding debt management, bankruptcy and asset protection. Ms. Saedi is a member of the State Bar of Georgia, American Bankruptcy Lawyer Institute, and American Bar Association. She is a volunteer with the International Refugee Committee and the Special Olympics of Georgia.

Many of these homeowners that feel trapped in a home that is “upside down,” are making the difficult decision to walk away from their properties. There are two areas where homeowners can use a chapter 13 bankruptcy filing to remain in their homes – one, when they are behind on payments and need time to get caught up, and two, to remove a second mortgage or home equity line of credit from their home.
Lien Stripping in Chapter 13
“Lien stripping” refers to the process of reducing a secured claim to the value of the underlying collateral. It uses the combined effect of 11 U.S.C.A. § 506(a) and 11 U.S.C.A. § 506(d) to bifurcate the lien into secured and unsecured. The secured lien is allowed in the amount up to the fair market value of the property at the time of the stripping. The balance of the lien, which exceeds the fair market value of the property, is now deemed unsecured.
Liens can be stripped off of the debtor’s assets in Chapter 11 or Chapter 13 when there is not enough equity in the assets. Section 506(a) and 506(d) of the Bankruptcy Code acknowledges that a lien is only a secured claim to the extent there is value in the asset to which it attaches. To the extent that the claim exceeds the value of the collateral, that portion of the lien is now unsecured. The most common application of lien stripping is the reduction of car loan liens to the present value of the vehicle however it is currently used more often with home mortgages in bankruptcy situations. Lien stripping with car loans has been limited to vehicles purchased over 910 days.

Receiving a foreclosure notice can be scary and traumatic. Filing bankruptcy will stop foreclosure, regardless of which type of bankruptcy you file. However, the depending on what chapter of bankruptcy you file will determine whether the foreclosure is stopped temporarily or permanently.
Chapter 13 bankruptcy can permanently stop a foreclosure. To qualify to stop a foreclosure in a Chapter 13, you must have enough income to pay mortgage payments after your filing date, in addition to a bankruptcy payment that will include mortgage #arrears, homeowner association #fees, car #payments, and a portion of #debt owed to unsecured #creditors, such as credit #card or medical #bills. For example, if you are 4 months behind on your mortgage, you must have the income to pay for the regular mortgage payment going forward, plus the 4 months you are behind, spread out over a 36 or 60 month period.
Chapter 7 bankruptcy will stop a foreclosure, but only temporarily. If your mortgage payments are behind and you file a Chapter 7, it is highly likely that you will ultimately lose the house unless you can pay back all the arrears before the Chapter 7 ends. Since Chapter 7 #bankruptcy usually only lasts between 4 to 6 months, there is a very short amount of time to pay back arrears. However, if your goal is to simply slow down the #foreclosure process, rather than completely eliminate it, Chapter 7 will accomplish that goal.
Loan modifications can save your home from foreclosure. However, in our experience, loan modifications occur infrequently, and often provide little help even when granted. Many times, families are turned down for loan #modifications because they lack the income needed to #pay even a reduced mortgage. Filing bankruptcy can aid in obtaining #modifications, since bankruptcy reduces the amount of money paid to other creditors. Also, removing second mortgages in bankruptcy can have a similar effect, freeing up cash that can instead be applied to the First Mortgage.
