DUI in Georgia. Why did the officer pull me over? Can my GA DUI attorney challenge an illegal arrest?
If your traffic stop was based on some alleged traffic violation, which provided the officer with “reasonable suspicion,” the police officer must prove that in court. When asked, he has the right to expect you to identify yourself, and to have you produce your driver’s license. Verify that your address is correct. Police officers receive DUI training, including mock trial practice, during which they must recite sufficient factual information derived from what they observed to support their decision to arrest a DUI suspect. DUI Arraignment | Avoid GA ALS | DUI Court Dates Explained
Long-time South Georgia DUI lawyer Joe Kunes explains DUI arraignments, DUI court dates you can expect, and how to stop GA ALS license suspension. To the extent possible, his office will obtain permission for you to NOT have to come to court. For your first appearance, the DUI arraignment, Joe and his law firm may be able to "waive" (forego) your presence, if the judge permits it. But, for some important stages of the case, like the administrative license suspension appeal hearing or pre-trial motions, you will need to be present, especially if your testimony or input is needed. Georgia DUI laws also mandate that you must be present for trial. Some states, like California, do not require the accused in misdemanor cases to be in court, even for trial, when represented by a criminal defense lawyer.
Joe prefers DUI jury trials, because this gives the client the best chance to win the case. Plus, before trial, many procedures and steps can be taken to try to eliminate DUI evidence of the prosecutor. Pretrial motions are essential to a DUI case in GA.
In a DUI bench trial the judge alone decides your fate. In these non-jury trials, the judge decides everything, including DUI punishment in Georgia. In a jury trial, the judge still decides issues of law such as whether the DUI breath test is excluded at a pre-trial motion, procedural questions like whether or not an expert witness should really be considered an expert, or whether or not an objection should be rejected, overruled or sustained (upheld). The jury, on the other hand, decides questions of fact such as who is telling the truth, or whether the evidence in the case justifies a verdict of guilty or DUI not guilty.
